It's pretty safe to say that nobody likes paperwork, right? Especially technical, time-consuming paperwork like W-4s and I-9s. Immigration and Customs Enforcement (ICE) is really starting to crack down on employers for incorrect I-9 paperwork. Even if it was an honest mistake, or a small error, you could still get hit with a substantial fine.
"Fines for unintentional I-9 omissions and mistakes can range from $110 to $1,100 per violation. While some business owners protest the fines as unfair because they aren’t hiring 'illegals,' that rationale is based on a misinterpretation of what ICE wants. ICE may not want employers to hire illegal workers, but neither do they want employers to take absolute responsibility for ensuring the legal status of employees. In fact, being too proactive here can easily result in discrimination and/or over-documentation charges." Continue reading this article, "I-9 Errors: Quite Costly, & P.S. Having Legal Hires Won’t Exempt You," by Kirsten Meyer on the Emptech Blog.
