How do I complete an I-9 for telecommuters?

An initial concern for employers with telecommuters is getting a company representative to sign Section 2 of the new employee’s I-9. This is supposed to be completed within three days of the new employee’s first workday – difficult when that employee may not live in the same geographic area. The solution? Ask a notary, a bank, or even a law firm to sign on behalf of the employer. Prepare a memo that informs the stand-ins that they are not liable for I-9 penalties, nor are they signing as agents of the employer. Your company’s address should still appear below the stand-in’s signature. This will demonstrate that the company is proactively trying to obtain accurate I-9s within the legal timeframe, despite having an atypical workforce.  For more information, please contact us.
